Unpaid Accounts Still On My Credit Report

Questions & AnswersCategory: Credit ProvidersUnpaid Accounts Still On My Credit Report
Anonymous asked 2 years ago

Good day.

I am sitting with a situation where debt was accumulated by an ex-boyfriend who I, without thinking, gave access to my accounts.

This was 2008/2009 so 6 years ago. I was unable to settle the debt then and I would like to know what my options are at the moment. Do I proceed with paying these accounts? Or is there a time period that this debt will fall away?

The two that are remaining on my account is Truworths and Woolworths.

Hi there.

Thank you for getting in touch.

Debt will only expire if it has prescribed: According to the law, most debt that is older than three years will be considered prescribed, or as ‘old debt’ if there has been no acknowledgement of the debt by the consumer or any attempt from the credit provider to collect the debt. Only then consumers are in no way obligated to settle it. Credit providers are now banned from collecting prescribed debt and are also prohibited from selling prescribed debt to any third party.

But if the debt has not prescribed then you’ll have to pay it. If the debt has been made in a fraudulent way then you will have to find legal advice to resolve the matter.

Hope this information helps.
