hoe is dit moontlik dat ‘n skool oorgee aan dept collectors, as jy grondige bewyse het van ‘n situasie, wat lank sloer om opgeklaar moet word, omstandighede is ‘n werksbesering met terminisering met ccma vir kwalifisering medies ongeskik met grondige dr’s bewyse

How is it possible for a school to hand you over to debt collectors if you have proof of a situation, that is dragging along and taking long to get solved, the circumstances are an Injury on Duty with termination and a CCMA to be approved as medically unfit with valid doctor’s notices.

Dankie vir die vraag.

Ongelukkig is die skool binne hulle reg om ‘n rekening wat agterstallig is te oorhandig vir invordering. Op die einde van die dag gaan dit voor ‘n hof getoets moet word om ‘n beslissing oor die saak te maak. Indien die skool ‘n fout maak en buite hulle reg optree sal die hof hulle kap.

Daar is dan die kwessie van redelikheid en billikheid. Indien ‘n saak nog nie 100% uitgeklaar is nie en jy wag vir terugvoering het jy genoeg verweer om te vra dat die hof die saak uitgooi en julle buite die hof skik.

Ek stel voor dat jy al die bewyse bymekaar maak en die skool se hoof gaan sien om vaste reelings te tref. Indien hulle reeds die saak oorhandig het kan jy hulel vra om dit terug te trek. uit my ervaring sal dit nie die geval wees nie en gaan hulle die saak by die invorderaars hou. Tref dan net met hulle ‘n reeling. Hou asb bewyse van al jou korrespondensie met enige party, en doen dit altyd op skrif.

Wanneer hulle jou hof toe wil sleep sal jy die bewyse kan voorle en die hof vra vir uitstel op die saak sodat jy ‘n finale beslissing kan kry op die CCMS uitspraak.

Unfortunately the school is within their rights to hand arrear accounts over for collections. At the end of the day the case will have to be brought before a court to make a ruling. Should the school be at fault and operate unlawfully the court will rule against them.

 

The there is the question of being reasonable. The school has to be reasonable and respect the fact that a situation has not yet been resolved. If they are bullying you and you explained to them the situation and you really tried from your side to make an arrangement, you should have enough evidence to build a defence and ask the court to postpone the matter or throw it out.

 

I suggest that you schedule a meeting with the school headmaster and try to put in place some sort of arrangement. you can also ask them to withdraw the case from the collectors. If they refuse and you still cannot pay the collectors, you will have to defend the matter in court.

 

Keep all you correspondence with anyone to serve as proof that you did indeed make an attempt to rectify the situation.
