I have been unemployed since 02-11-2016. My last payment on my credit card was the end of November. That account has been handed over. Legal fees have double the outstanding amount. They are now taking the matter to court. I am still unemployed and have zero income. I don’t think I have any assets in my name. No car, no house. How will this proceed? Will they take my mother’s car and her TV and fridge?

Hi there,

It is so unfortunate that you lost your employment. If you have been retrenched there might be a chance that you have a credit cover policy with a retrenchment benefit. You should enquire with your credit providers about this, especially the credit card.

A credit cover policy ensures your debt against things like accidental death and disability. There are various products, and the credit provider usually imbed them as part of the credit agreement.

Rest assured that they will not be able to take your mother’s assets. She is the owner. They can only attach your assets. Also take note that it does not happen overnight. They have to issue you with a section 129 notice and eventually a summons if things get that far. Just respond to them, try and make an arrangement, and do it all in writing. When you find new employment you can make them a decent offer. Just keep the communication channels open.
