Thank you for your question. The National Credit Act provides for a clearance certificate to be issued when you have settled your debt that was included in the debt review. This clearance certificate is referred to as a Form19 and must be sent to all your credit providers as well as all registered credit bureaus. This was specifically done in order to clear a consumer’s credit record after the debt review has been finalised.
Upon receipt of such clearance certificate the credit bureau must expunge from their records any information pertaining to the fact that you were subject to a debt review. In other words, they must clear the debt review from your credit record.
It is sad to hear that your debt counsellor is no longer practicing. Luckily the act does not say that you have to apply to your original debt counsellor for a clearance certificate. If you have proof that you paid the accounts and have confirmation from your credit providers that the balances have been settled you can apply to any debt counsellor for a clearance certificate. Keep in mind that the might be a fee attached to this.
You can do the following;
1. Obtain confirmation letters from all your credit providers where they confirm that the balances has been settled.
2. Obtain a copy of the court order that was issued with your debt review.
3. Get a copy of your ID ready
4. Contact a debt counsellor and enquire about the service.
5. Send documentation through to DC.
The debt counsellor must then construct the Form19 and send it to everyone and also give you a copy of the Form 19.
You should then give it about a month, and then pull your credit report again. If there are still information on your credit record that should not be there, you have the right to dispute it with the credit bureau.
