New debt counselling regulations have just been issued. These regulations provide far clearer direction to the courts on the process of applying for a debt counselling court order. Before these debt counselling regulations, the process was not standardised or clearly understood. It took the Department of Trade and Industry far too long (nearly five years) to regulate this legal process and the uncertainty resulted in many consumers not getting court orders to protect their payment arrangements. That should now change as debt counsellors should be able to go to court and find fewer legal obstacles to getting the court order issued.
